A significant challenge faced by patent illustrators is properly applying shading to achieve a 3D sense in a drawing, given that a line is by nature a 2D trace of an object in a plane. However, shading is one of the primary ways to clearly show the character and contour of the surfaces and any three-dimensional aspects of the design. A lack of appropriate surface-shading in a filed drawing may render the shape and contour of the design non-enabling.
To address this challenge, IP DaVinci has developed a revolutionary new technology to apply photo-realistic stippling (USPTO-approved dot surface-shading). Our stipple-shading technique is so accurate that the shape of all design elements (no matter how small) is definite from the disclosure as filed (as required by 35 U.S.C. 112 (a) & (b)).

Indefiniteness and non-enablement can be caused by inexperience and lack of subject-matter expertise within the team to make the right call, for example, failing to use sufficient corroborating views or claiming unnecessary elements with solid lines. We go the extra mile to make sure that hard-to-reach areas of the claimed design are properly disclosed with a sufficient number of corroborating views and proper shading to avoid a rejection by the USPTO examiner. We do an excellent job in disclaiming unnecessary elements with broken lines (this “broadens” the claim of the design patent and avoids unnecessary non-infringement positions) and deleting and/or simplifying superfluous details to free the drawing from unnecessary elements (for example, hardware and other small parts can be removed from the drawing and the claimed junction is simplified once the hardware is removed.
